Privacy Policy

Our Privacy Policy was last updated on July 6, 2023.

This Privacy Policy describes our practices in connection with the information collected from our Sites, through our online advertisements on third-party Sites, and through vendors/sources from which we source information.

This Privacy Policy applies to the information we obtain from individuals interacting with us and our Sites, products, and services. It does not apply to information we obtain in our capacity as an employer.

  • “Company” (referred to as either “Seastone IP LLP”, “the Company”, “we”, “us” or “our” in this Privacy Policy) means Seastone IP LLP.

  • “Personal Information” means information about an identifiable individual, that identifies the individual such as name, date of birth or age, email address, and telephone number, as defined by applicable law”.
  • “Services” means legal services;
  • Site(s)” means the Company website (www.seastoneip.com), social media pages that we control, widgets and mobile sites and applications, blogs, interactive applications, email messages that we send to you, and other digital/online properties on which these terms are posted or referenced (unless a different or additional policy is provided on a particular site, application, or service, in which case such different policy shall govern and control).
  • “You” means the individual accessing or using the Sites.

We take the protection of Personal Information seriously. We have specific procedures in place to protect your personal information.

We require all employees, contractors and agents to comply with these obligations.

They also enable us to measure and analyse your behaviour on our Site and are required to show you personalised advertisements on our Site or on third-party Sites. Service Providers may require or be provided with access to your Information in order to make some or all of the uses of the Information referred to above on our behalf and/or to perform the Services on our behalf. We make commercially reasonable efforts to ensure that all Service Providers acting on our behalf provide a level of protection for your Personal Information comparable to the level of protection that we provide.
  • Within the Company: We may upload, move, store, process, back up, transmit, and/or transfer your Personal Information between any of the Canadian provinces in which we operate to enable us to use the Personal Information in accordance with this Privacy Policy. We do not store any of your Personal Information outside of Canada. We may disclose your Personal Information to any of our employees, officers, insurers, professional advisers, agents, Service Providers, suppliers or subcontractors, to the extent that such disclosure is reasonably necessary for the purposes set out in this Privacy Policy.
  • With Law Enforcement: We may also need to provide Personal Information to law enforcement bodies in order to comply with any legal obligation or court order.
  • For Business Transfers: We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.

By providing your Information to Seastone IP LLP, you consent to us using your Personal Information for the purposes outlined above.

Any Personal Information provided by you, or that is derived automatically by or through the Site and/or the Services, is not sold, rented, or shared by us with any third party without your consent, except as described in this Privacy Policy.

5. Accuracy and Access to Personal Information

You may view your Personal Information on file with Seastone IP LLP and may request that corrections be made to such Personal Information. Any requests to view or correct your Personal Information on file with Seastone IP LLP can be directed by email to bpearson@seastoneip.com.

Seastone IP LLP obtains your consent to collect, use, or disclose your Personal Information, except where no such consent is required by law.

The method of obtaining consent depends on the circumstances and the sensitivity of the information. Consent may be oral or written, express or implied. Your express consent (verbal, written, or electronic agreement) is obtained to collect, use, or disclose sensitive personal information. Implied consent is obtained in circumstances where a customer relationship already exists, express consent has previously been given, or the purpose of using the personal information is reasonably apparent to you. You may “opt-out” or withdraw your consent to the collection, use, and disclosure of your Personal Information as set out in this Privacy Policy at any time. Withdrawal of your consent may result in the Services or certain aspects of the Services being unavailable to you. After withdrawal, Seastone IP LLP reserves the right to limit your access or prevent you from accessing the Services, through the Site or otherwise.

7. Limiting Collection, Use, Disclosure and Retention of Personal Information

Seastone IP LLP may collect Personal Information in many forms (for example, hard/soft copy, electronically, email, etc.), but will only do so by lawful means and only for necessary purposes that have been disclosed to you, are described in this Privacy Policy, or are permitted or required by applicable law.

We will not keep Personal Information for any longer than is necessary for the purposes identified in this Privacy Policy. Personal Information no longer required will be destroyed, erased, or made anonymous.

8. Safeguards 

We will take appropriate technical, physical, and organizational measures to protect the Personal Information collected through the Site from misuse or accidental, unlawful, or unauthorized destruction, loss, alteration, disclosure, acquisition, or access, that is consistent with applicable privacy and data security laws and regulations. However, no internet-based site can be 100% secure and we cannot be held responsible for unauthorized or unintended access that is beyond our control.

9. Third- Party Policies

You may choose to share information on our Site via social media. Accordingly, the information you share, with name and preferences, will be visible to visitors of your personal pages. We advise you to carefully read the privacy policies of the social media parties, as these are applicable to the processing of your Personal Information by these parties.

The Site may include hyperlinks to, and details of, third-party Sites or Internet resources. Company does not endorse, approve of, verify, attest to, or offer any representation or warranty with respect to the accuracy of the content of such linked Sites. If you decide to leave the Site and access these third-party sites, you do so at your own risk.

We cannot control any policies or terms of such third-party social networks. As a result, we cannot be responsible for any use of your Information or content by a third-party social network, which you use at your own risk.

10. Amendments

From time to time we may review and revise our privacy practices and this Privacy Policy. In the event of an amendment, an appropriate notice will be posted on our website.

Your continued use of our Sites and/or provision of Information to us after any amendments constitutes your acceptance of, and agreement to, this Privacy Policy as revised.
