A majority of the Federal Court of Appeal refused to increase sanctions for copyright infringement from $40,000 to $200,000. The minority, however, found $40,000 to be “demonstrably unfit” given the “aggravating circumstances” and would have ordered incarceration because of the defendants’ continued acts of contempt after being found guilty. The minority also described the Federal Court as a “safe haven for persons in contempt” when compared to provincial courts of Canada.
