The Federal Court awarded $150,000 in damages (i.e. lost profits) for patent infringement as well as $250,000 in punitive damages against two defendants. The award of punitive damages resulted from “knowing infringement” coupled with “aggravating circumstances” including reprehensible conduct by the defendants and attempts to conceal evidence and mislead the court. The court sought to “severely denounce” the conduct and the “cover-up.”
