Licensee loses trademarks registered in bad faith

While a licensee, the defendant improperly registered trademarks belonging to the licensor. In a thorough analysis, the Federal Court: (i) expunged the licensee’s trademarks (non-entitlement and bad faith grounds); (ii) awarded the plaintiff damages for passing off ($20K) and punitive damages ($5K), (iii) granted an injunction; (iv) ordered delivery up of infringing materials; and (v) awarded costs and disbursements.
