In a copyright case, the Federal Court applied the well-known three-part test for an injunction from RJR-MacDonald finding the moving parties failed to prove they would suffer irreparable harm. The Court held the moving parties would likely recover a monetary award if they are successful at trial and their evidence that irreparable harm would arise from loss of control over the original work or loss of clients could be remedied by a monetary award. In the result, the Court dismissed the motion for an interim injunction.
