The Federal Court of Appeal confirmed a valid trademark licence must control the quality of the “finished product” rather than the quality of the raw ingredients or constituents parts that make up the finished product. The objective of the trademark license provisions is to ensure all licensees produce, and the public receives, the same quality of finished product.
