In a long running trade secret misappropriation case, the BC Court of Appeal ordered a partial stay of execution of the Certificate of Costs obtained at trial. The Court agreed the onus lies on the applicant to establish the right to a stay; but the the ultimate consideration is whether granting a stay is in the interests of justice. In the end, the Court ordered payment of approximately half of the legal fees of the respondent with the other half being paid into Court until the appeal is resolved.
