Costs awarded against a party that did not take part in appeal

In an appeal of a decision of the trademark Registrar, the successful appellant was awarded costs against a respondent that took no part in the appeal. The Federal Court ultimately held the new evidence filed by appellant showed use of the NAVIGATOR trademark in Canada and allowed the appeal.
