The Federal Court holds that affixing a trademark to: (i) goods manufactured by a third party; and (ii) packages containing the goods manufactured by a third party, amounts to use of the trademark in association with the goods in Canada. Examples include on hang tags and labels attached to clothing and decals and stickers applied to vehicles.
